TIVEY FAMILY TREE

This is the last Will and Testament of me Phoebe Tivey of Cranky's Plain near Bombala in the Colony of New South Wales Widow, I give devise and bequeath all my real and personal estate of what nature or kind soever and wheres ever situate of which I shall die seized possesses or entitled to whether in the Estate of my late husband Samuel Tivey deceased or otherwise to my son Samuel Tivey now of Cooma and my daughter Ellen Amelia Tivey of Cranky's Plane aforesaid equally as Tenants in common and not as joint tenants their heirs Executors and Assigns for ever and I direct that the share of my said daughter Ellen Amelia Tivey shall be held by her as and in the nature of her separate Estate free from the debts control interference or engagement of any husband with whom she may intermarry. I appoint my son Alfred Tivey and in the event of his decease or renouncing probate my son in law James Thomas to be Executor of this my Will. Lastly I revoke all other Wills In Witness whereof I the said Phoebe Tivey have hereunto set my hand to this my Will this fifth (5th) day of February in the year of our Lord one thousand Eight hundred and seventy seven.

Signed and acknowledged by the said testator as and for the last Will in the presence of  present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses

4th November 1879 This day upon Petition Probate of the last Will and Testament of Phoebe Tivey, late of Cranky Plains near Bombala Widow deceased was granted to Alfred Tivey the Executor named in said Will, Testator died 31st August 1878. Goods sworn under £700 Probate dated 4th November 1879.
