Emma-Tivey's-Will-Of-Melbourne-Derbyshire
This is the last will of me Emma
Tivey of Melbourne in the County of Derby Spinster. I give the
Oil Painting being a portrait of the late Miss Tomlinson[i]
also the photograph of the same Miss Tomlinson now hanging in my
front room downstairs together with the photograph of the same
Miss Tomlinson in the front room upstairs framed in maple and
the albums with green cover containing portraits of Miss
Tomlinson Mrs Earp’s[ii] family etc to Mrs
Earp of the Church House Melbourne her heirs and successors. I
also give to the said Mrs Earp or her heirs and successors any
of the stuffed animals in cases which they or she may care to
possess of. I give the small oak chest now in my back bedroom to
doctor Arnold Ingle[iii] of Cambridge. I
give my eight day clock also my drawing of the Crystal Palace of
the late William Ensor to my brother Arnold Tivey[iv]
of Melbourne and I appoint him to be the sole executor of this
my will. I give my clothes to be divided into six equal portions
as nearly equal in value as may be and distributed one portion
each to Emma Hollingworth[v] of Melbourne
Annie Pass[vi] of Blackpool Fanny Kinsey[vii]
of Melbourne Mary Ann Smith[viii] of
Melbourne and Emma Foster[ix] of Melbourne
also one portion to my sister Bessie Webster[x].
I give my investment in the municipal building society to the
Baptist Missionary Society. All the remainder of my property I
give to my sole executor afore named Arnold Tivey upon trust as
soon as possible to sell and convert into money each parts as to
not invest of money and divide the proceeds together with any
other money after my debts funeral to any other expenses are
paid (including five pounds to be paid to the said Arnold Tivey
for acting as my sole executor) into five equal portions one
portion to be retained by my said brother Arnold Tivey for his
sole use and benefit and one portion to be divided equally
between my sister Bessie Webster and her daughter Emma
Hollingsworth and one portion to be divided equally between the
three children of the late Jeffrey Pass[xi]
formerly of Melbourne or such of them as survive and one portion
to be equally to be divided between the four daughters of Samuel
Pass[xii] and one lot to be equally
divided between Arthur Pass and his three daughters each portion
to be equally divided among the persons indicated or such of
them survive Signed Emma Tivey Signed by the Testatrix as her last will in the presence of us, present at the same time, who in her presence, and in the presence of each other, have subscribed our names as witness -- Arthur Henry Coombs Melbourne Baptist Minister Henry Beardsley Melbourne, Boot Finisher Probate - On the 27th day of March 1900 probate of this will was granted at Derby to Arnold Tivey the sole executor ANALYSIS - [i] Emma was a servant in the household of Miss Tomlinson mentioned in the portraits. She was Hannah Tomlinson, a spinster who inherited her father David’s farm and lived off its means. Hannah was the daughter of David Tomlinson and Hannah Webster. [ii] Mrs Earp of the Church of the Church House Melbourne was Ann Harriet (nee Bowles) Earp wife of Henry Webster Earp. Henry Webster Earp was the son of John Earp and Mary Tomlinson. Mary was the sister of Hannah who Emma served most of her life and who’s portrait she bequeathed. [iii] Dr Arnold Ingle was the son of Selina Earp and Robert Nicholas Ingle. Selina is the daughter of John Earp and Mary Tomlinson sister of Hannah as aforementioned. [iv] Arnold was Emma’s brother born 1839 in Melbourne shortly before his father Thomas’ death in 1841. His mother Mary (Nee Wilmott) remarried to John Pass in 1843. [v] Emma Hollingworth was the daughter of Emma’s half sister Elizabeth (Bessie) Pass. Elizabeth was the daughter of John Pass, 2nd husband of Mary Tivey (nee Wilmott~ the widow of Thomas Tivey). Elizabeth married Robert Webster in 1867 and Emma was born in 1867, their only child. Emma married John Hollingworth of Derby in Pancras London, 1889. [vi] Annie Pass- not traced as yet [vii] Fanny Kinsey was the daughter of Arthur Pass, Emma’s half brother (see note 8) Fanny Pass was born abt 1873 in Melbourne and married John Kinsey in 1890. [viii] Mary Ann Smith refers to Emma’s half brother Arthur’s child. Arthur was born to Mary Pass (Nee Tivey, Nee Wilmott ~ Emma’s mother) and John Earp in 1852. He married his first wife Eliza Smith in 1872. Mary Ann Pass was born abt 1873 Melbourne. She married Thomas Smith in 1896. [ix] Emma Foster was the daughter of Emma’s half brother Arthur (see note 8) Emma Pass was born abt 1878 Melbourne and married William Foster in 1897. [x] Bessie Webster was Emma’s half sister. She was the daughter of Mary Pass (Nee Tivey Nee Wilmott ~ Emma’s mother) and John Earp and was born abt 1848 in Melbourne. She was baptised Elizabeth Pass but was known as Bessie. In 1867 she married Robert Webster and had one child that survived infancy ~ Emma in 1869. [xi] Jeffrey Pass- changed his name to John Pass after the 1861 census and moved to Sheffield where he married widow Emma Morton – they had three children – Mary 1866, Wilmot 1869 and John 1872 all born in Sheffield. [xii] Samuel Pass was the half brother of Emma, being the eldest son of her mother Mary (Nee Tivey Nee Wilmott) and her second husband John Pass. Samuel married Mary Amanda Moll and had 11 children, 4 of them being daughters Ada (c) 1878 Alice (c) 1880 Mary (c) 1883 and Agnes (c) 1885. He died in 1890. |
